Compliance with FAR Part 31 has always been a challenging area. While many areas of FAR Part 31 are black and white there are quite a few that are grey. This is partly due to how FAR Part 31 is written. Out of necessity, it does not in all cases address specific situations; but provides general rules that then require interpretation by contractors, auditors, contracting officers and the courts. With increased interpretation by multiple parties comes increased compliance risk. 
 
This presentation will focus on some of the higher risk parts of FAR Part 31. We will discuss our experience with these issues and provide insights for the key elements that can differentiate whether a cost should be treated as allowable or unallowable.
 
Key discussions will include:

  • An introduction to the structure and content of FAR Part 31
  • The trifecta of FAR part 31 success (emphasis on high risk areas)
    • Allowability, allocability and reasonableness
  • Supporting decisions requiring interpretation - documentation around key elements of matters of interpretation can win or lose an argument
  • Cause and effect – understanding potential risk of positions in grey areas

Presenters

Long Nguyen, CFE, is a manager at CohnReznick and a member of the Firm’s Government Contracting Industry Practice with eight years of experience in the areas of federal contract auditing, Defense Contract Audit Agency, and cost accounting and estimates. He has extensive knowledge of the Federal Acquisition Regulations (FAR) and Cost Accounting Standard Requirements (CAS); indirect rate design; direct and indirect cost charging/billing practices; various cost and estimate analysis; and federal regulations and requirements on cost allowability, allocability, and reasonableness. He is also experienced in both preparation and performance of audits related to incurred cost, business systems, CAS disclosure statements and CAS compliance, contract terminations, and forward pricing activities.

Jeff Witt, CPA, CIA, CFE, is a senior manager at CohnReznick and a member of the Firm’s Government Contracting Industry Practice with over 25 years of experience in the areas of federal contract compliance. He has extensive knowledge of the Federal Acquisition Regulations (FAR) and Cost Accounting Standard Requirements (CAS); indirect rate design; direct and indirect cost charging/billing practices; various cost and estimate analysis; and federal regulations and requirements on cost allowability, allocability, and reasonableness. Jeff has worked as a DCAA auditor, a Controller for a government contractor, and while working as a CPA, as both an auditor and consultant to government contractors.
