Massachusetts Property Tax Certification for Manufacturers

Synopsis
 
Any corporation or business entity taxable as a corporation must certify its tax status by April 1, 2016. A corporation or a business entity classified as a manufacturer by the Massachusetts Department of Revenue must be certified in order to qualify for local personal property tax exemptions of manufacturing equipment.
 
Issue
 
The Massachusetts Department of Revenue (MA DOR) requires any corporation or business entity taxable as a corporation and classified as a manufacturer to certify its tax status by April 1st to qualify for applicable local personal property tax exemptions. Certifying entities are included in the annual Corporations Book used by local assessors to determine which businesses qualify for applicable property tax exemptions. Corporations failing to complete and comply with the certification by April 1, 2016 may not be listed in the Corporations Book and be unable to receive personal property tax exemptions to which it would otherwise be entitled. 
 
Process
 
Taxpayers can submit the required certification by going to MassTaxConnect and selecting the I Want To tab at the bottom of the page and clicking on the “Submit Annual Certification of Entity Tax Status” link. The Taxpayer should complete questions on the initial and subsequent screens to finalize and submit the certification. After the certification has been submitted, taxpayers will receive a Certification Confirmation Code and Confirmation Number from MassTaxConnect. The Confirmation Code can be used to review the request by clicking on the “Find a Request” link under the Quick Links tab at the bottom of the MassTaxConnect page. The Confirmation Number is reported on Section 1-D of the personal property return filed with the assessor of the city or town where the property is located.   
 
NOTE: Entities not owning any real or personal property in Massachusetts as of January 1st, non-profit corporations, and sole-proprietors are not required to certify tax status.
 

What Does CohnReznick Think?
Qualifying taxpayers should certify the business’ applicable status as soon as possible, but no later than April 1, 2016, to ensure the ability to qualify for appropriate treatment of property owned within Massachusetts.
