Topics/issues to be addressed during Scott’s panel will include a perspective on separate accounts vs. commingled funds, investor return expectations, investor patience for allowing true market performance, changes in investment strategy, moving beyond core investments to possibly opportunistic, how the political environment will likely impact fund investment strategies in 2013, current risk tolerance, anticipated allocations to real estate, favored asset classes as well as recent commitments, investments to be avoided and US investments vs. investing overseas.

Investing in emerging managers and small cap funds: Institutional Investor Perspective

David’s panel will address such critical issues as the criteria for selecting emerging managers, a perspective on emerging manager platforms that are not minority/women-owned, what it takes for small cap/niche funds to get investor interest, how small cap funds can best work with their investor base, capital raising tips, sourcing emerging managers/small cap funds, advantages emerging/small cap/niche funds have over large/brand name funds plus whether or not institutional investors will select emerging/small cap/niche funds as a viable investment vehicle going forward.

Navigating Anticipated Changes in Tax Laws & Understanding Key Tax Considerations for Distressed Debt Investments

Panelist: Gregg Bloomberg

Gregg’s session will address the latest in proposed tax changes such as the taxation of carried interests and a raise in the capital gain rate and how these changes might affect real estate investors in terms of the structure and pricing of investments. Other key tax-related issues to be discussed will include when to consider investing in real estate debt, cancellation of indebtedness income, an exploration of tax-advantaged structures, local transfer taxes (who pays it?), adverse tax consequences a lender might face, debt/equity exchanges and Treasury guidance on restructuring issues.

Dodd-Frank/JOBS/Volcker - Regulatory Change is Coming: Understanding the Impact and What Real Estate Funds Need to Do Now”

Panelist: Josh McCabe

Josh’s panel will provide a roadmap of current and anticipated regulatory changes that will undoubtedly impact funds and their real estate investment strategies going forward. Issues discussed will include a brief overview of the key regulations and their impact on fund strategy and real estate investment over the past 12 months. Then, anticipated regulatory change and likely implications will be addressed such as the consequences of registering as an RIA, what costs were involved, any surprises or lessons learned, the ability of fund managers to NOT register and what exemptions are relevant, reporting requirements and their impact, fund structures and structuring, and is the SEC really prepared for all this? What are their current issues and concerns? What further changes might be forthcoming? What about the SEC vs. state registration? How will CMBS origination and financing be affected, and, finally, what do the new rules say about debt funds?
